Price fixing by any other name is still price fixing, argues Allen's Blueberry Freezer of Ellsworth, the sole processor unwilling to settle with blueberry growers in a price-fixing case. The company maintains that the settlements, which order minimum prices for the next four years, are price fixing as well.

Allen's refused to settle and had one of its appeals of the case heard in Maine Superior Court. That court's response was to send the case back to Superior Court and Justice Joseph Jabar.
